David B Bates Photography offers real estate media services including but not limited to:
● Photography and videography
● 3D virtual tours (e.g., Matterport)
● Aerial drone media
● Floor plans and virtual staging
● Social media content packages
2. Eligibility
You must be at least 18 years old to use our services or submit personal data via our website.
3. User Responsibilities
When using our website or booking services, you agree to:
● Provide accurate and current information.
● Not use the services for unlawful purposes.
● Comply with local regulations related to property media (e.g., permissions for drone flight).
4. Booking, Rescheduling, and Cancellations
● Bookings must be confirmed via our online portal or directly with our team.
● Rescheduling or cancellations must be made at least 24 hours in advance.
● Same-day cancellations may be subject to a $75 cancellation fee, unless due to weather or emergencies.
● We reserve the right to cancel or reschedule due to inclement weather, safety issues, or technical constraints.
5. Copyright and Media Usage
● All media content (photos, videos, 3D tours) produced by Real Tours remains the intellectual property of David B Bates Photography unless a licensing agreement states otherwise.
● Clients are granted non-exclusive usage rights for marketing purposes on MLS platforms, social media, or real estate websites.
● Unauthorized resale or modification of the media is prohibited.
6. Communication Consent
By submitting your contact information, you consent to receive:
● Service confirmations and reminders
● Marketing communications and listing updates

7. Limitation of Liability
David B Bates Photography shall not be liable for any indirect or consequential damages arising out of your use of our services. We are not responsible for delays due to weather, technical failure, or property access issues.
8. Termination of Service
We reserve the right to suspend or terminate service to any user who violates these Terms or engages in harmful, abusive, or illegal behavior.
9. Modifications
We may update these Terms from time to time. Revisions will be posted on this page with an updated effective date. Continued use of our services indicates your acceptance of those changes.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
